PUBLIC OFFER<\/strong><\/p>\n

1. General provisions<\/strong>
\n1.1. This offer is an official offer of the sole proprietor of the sole proprietorship Rybak G.O., hereinafter referred to as the \u201cSeller\u201d, to conclude a contract for the sale of goods remotely, that is, through the online store, hereinafter referred to as the \u201cAgreement\u201d, and places the Public Offer (offer) on the official website of the Seller \u201cgrace-garden.com.ua\u201d (hereinafter referred to as the \u201cWebsite\u201d).<\/p>\n

1.2. The moment of full and unconditional acceptance by the Buyer of the Seller’s offer (acceptance) to conclude an electronic contract for the sale of goods is considered the fact that the Buyer has paid for the order on the terms of this Agreement, within the terms and at the prices indicated on the Seller’s website.<\/p>\n

 <\/p>\n

2. Concepts and definitions<\/strong><\/p>\n

2.1. In this offer, unless the context requires otherwise, the following terms have the following meanings:<\/p>\n

* \u201cProduct\u201d – kitchen modules;<\/p>\n

* \u201cOnline store\u201d – in accordance with the Law of Ukraine \u201cOn Electronic Commerce\u201d, a means for the presentation or sale of goods, work or services through an electronic transaction.<\/p>\n

* Seller – a company that sells the goods presented on the Website.<\/p>\n

* \u201cBuyer\u201d – an individual who has entered into an Agreement with the Seller on the terms set forth below.<\/p>\n

* \u201cOrder\u201d – the selection of individual items from the list of goods specified by the Buyer when placing an order and making payment.<\/p>\n

 <\/p>\n

3. Subject of the agreement<\/strong><\/p>\n

3.1. The Seller undertakes to transfer the Goods to the Buyer’s ownership, and the Buyer undertakes to pay for and accept the Goods on the terms of this Agreement.<\/p>\n

This Agreement governs the sale and purchase of goods in the online store, including:<\/p>\n

– voluntary selection of goods by the Buyer in the online store;<\/p>\n

– independent ordering by the Buyer in the Online Store;<\/p>\n

– payment by the Buyer for the order placed in the Online Store;<\/p>\n

– processing and delivery of the order to the Buyer in accordance with the terms of this Agreement.<\/p>\n

4. Ordering procedure<\/strong><\/p>\n

4.1 The buyer has the right to place an order for any product presented on the website of the online store and available.<\/p>\n

4.2. Each item can be presented in the order in any quantity.<\/p>\n

4.3. In the absence of goods in the warehouse, the Company Manager is obliged to notify the Buyer (by phone or e-mail).<\/p>\n

4.4. In the absence of goods, the Buyer has the right to replace it with goods of a similar model, refuse this product, cancel the order.<\/p>\n

 <\/p>\n

5. Order payment procedure<\/strong><\/p>\n

5.1. Payment is made on the site using the PrivatBank LiqPay electronic payment system or cash on delivery upon receipt of the goods at the branch of the transport company for cash in UAH.<\/p>\n

5.2. If the funds are not received, the Online Store reserves the right to cancel the order.<\/p>\n

6. Terms of delivery of the order<\/strong><\/p>\n

6.1. Delivery of goods purchased in the Online Store is carried out to the warehouses of transport companies, where orders are issued. Delivery of goods purchased through the Online Store is carried out through the carrier company according to the current tariffs of the carrier.<\/p>\n

6.2. Delivery of the Orders within the territory of Ukraine is carried out by the carrier \u201cNova Poshta\u201d LLC. The cost of delivery of each Order is calculated independently by the carrier, based on the weight of the Order, region and method of delivery.<\/p>\n

6.3. International delivery of Orders is carried out through the postal operator JSC Ukrposhta.<\/p>\n

6.4. Together with the order, the Buyer is provided with documents in accordance with the legislation of Ukraine.<\/p>\n

 <\/p>\n

7. Rights and obligations of the parties:<\/strong><\/p>\n

7.1. The Seller has the right to:<\/p>\n

– unilaterally terminate the provision of services under this Agreement in case of violation by the Buyer of the terms of this Agreement.<\/p>\n

7.2. The Buyer is obliged to:<\/p>\n

– timely pay and receive the order on the terms of this agreement.<\/p>\n

7.3. The buyer has the right:<\/p>\n

– place an order in the online store;<\/p>\n

– to draw up an electronic contract;<\/p>\n

– require the Seller to fulfill the terms of this Agreement.<\/p>\n

 <\/p>\n

8. Responsibility of the parties<\/strong><\/p>\n

8.1. The Parties shall be liable for non-fulfillment or improper fulfillment of the terms of this Agreement in the manner prescribed by this Agreement and the current legislation of Ukraine.<\/p>\n

8.2. The Seller shall not be liable for damage caused to the Buyer or third parties due to improper installation, use, storage of the Goods purchased from the Seller.<\/p>\n

8.3. The Seller shall not be liable for improper, untimely fulfillment of the Orders and its obligations in case the Buyer provides false or erroneous information.<\/p>\n

8.4. The Seller and the Buyer are responsible for fulfilling their obligations in accordance with the current legislation of Ukraine and the provisions of this Agreement.<\/p>\n

8.5. The Seller or the Buyer shall be released from liability for full or partial failure to fulfill their obligations if the failure is the result of force majeure circumstances such as war or hostilities, earthquake, flood, fire and other natural disasters that have arisen regardless of the will of the Seller and \/ or the Buyer after the conclusion of this agreement. The side that is unable to fulfill its obligations shall immediately notify the other Side.<\/p>\n

9. Return of goods<\/strong><\/p>\n

9.1. The return of goods to the Online Store is carried out in accordance with the current legislation of Ukraine.<\/p>\n

9.2. Return of the goods to the Online Store is made at the expense of the Buyer.<\/p>\n

9.3. In accordance with the Resolution of the Cabinet of Ministers of Ukraine dated March 19, 1994 No. 172 \u201cOn the Implementation of Certain Provisions of the Law of Ukraine \u2018On Consumer Protection\u2019, printed publications of good quality are not subject to exchange or return.<\/p>\n

9.4. In the event of a printing defect in the book products, the Seller, at the request of the Buyer, exchanges the goods for goods of good quality, or makes a refund in the amount of the cost of the returned products. A printing defect is a defect resulting from non-compliance with the production technology, which leads to distortion or loss of information: smearing of paint, fuzzy printing, glued pages, uneven cropping, turned over pages, missing pages or their repetition, inconsistency of the book title on the cover with its content, etc.<\/p>\n

9.5. Exchange or return of goods is possible within 14 days, excluding the day of purchase. The exchange or return of goods is carried out if they have not been used and their presentation is preserved, as well as the payment document issued by the seller together with the goods.<\/p>\n

9.6. The goods that have been taken from the carrier’s office and have severe mechanical damage caused by any actions of the buyer or third parties; a defect caused by force majeure, an accident; traces of foreign objects, liquids, insects, chemicals and other substances inside the goods are not subject to exchange and return.<\/p>\n

9.7. When the Buyer returns the Goods of good quality, the Online Store shall refund the amount paid for the Goods upon return of the Goods, less compensation for the costs of the Online Store related to the delivery of the Goods to the Buyer.<\/p>\n

9.8. E-books are not subject to return or exchange. If the Buyer, after paying for the provision of access to download the electronic content, is unable to download it directly for technical or any other reasons (arising on the part and through the fault of the Buyer), no refund shall be made, and the electronic content shall be considered as having been received properly. Refunds are possible only if the Seller has provided a non-working file (which cannot be reproduced or saved (if this is proved after verification by the Seller) and if the Seller cannot replace such file. Thus, electronic content of good quality is not subject to return and exchange.<\/p>\n

10. Confidentiality and protection of personal data.<\/strong><\/p>\n

10.1. By providing his personal data on the website of the online store when registering or placing an Order, the Buyer provides the Seller with his voluntary consent to the processing, use (including transfer) of his personal data, as well as to perform other actions provided for by the Law of Ukraine \u201cOn Personal Data Protection\u201d, without limiting the validity of such consent.<\/p>\n

10.2. The Seller undertakes not to disclose the information received from the Buyer. It shall not be considered a violation if the Seller provides information to counterparties and third parties acting on the basis of an agreement with the Seller, including for the fulfillment of obligations to the Buyer, as well as in cases where the disclosure of such information is required by the requirements of the current legislation of Ukraine.<\/p>\n

10.3. The Buyer is responsible for keeping his personal data up to date. The Seller is not responsible for poor performance or failure to fulfill its obligations due to the irrelevance of information about the Buyer or its inconsistency with reality.<\/p>\n

11. Other terms and conditions<\/strong><\/p>\n

11.1. The Online Store reserves the right to unilaterally amend this Agreement subject to its prior publication on the website https:\/\/grace-garden.com.ua<\/p>\n

11.2. The online store is designed to organize a remote method of selling goods via the Internet.<\/p>\n

11.3. The buyer is responsible for the accuracy of the information specified when placing an order. At the same time, when making an acceptance (placing an order and subsequent payment for the goods), the Buyer gives the Seller his unconditional consent to the collection, processing, storage, use of his personal data, within the meaning of the Law of Ukraine \u201cOn Personal Data Protection\u201d.<\/p>\n

11.4. Payment by the Buyer for the order placed in the online store means the Buyer’s full consent to the terms of the purchase and sale agreement (public offer)<\/p>\n

11.5. The actual date of the electronic agreement between the parties is the date of acceptance of the terms and conditions, in accordance with Art. 11 of the Law of Ukraine \u201cOn Electronic Commerce\u201d<\/p>\n

11.6. Using the resource of the online store for previewing the goods, as well as for placing an order for the Buyer is free of charge.<\/p>\n

11.7. The information provided by the Buyer is confidential. The Online Store uses the information about the Buyer solely for the purpose of processing the order, sending notifications to the Buyer, delivering the goods, making settlements, etc.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
